Ailing Colombo soldier turned used car salesman sentenced to jail for violating parole

An ailing Brooklyn Colombo family soldier-turned-used-car-salesman was sentenced Tuesday to a year and a day in prison for violating parole by communicating with other former mobsters.
Brooklyn Federal court judge Kiyo Matsumoto handed down the sentence at the behest of Ilario "Fat Larry" Sessa’s attorney James Froccaro, who noted that the mobster wouldn’t be eligible for time off for good behavior unless he was sentenced to at least one day longer than a year.
In court papers, Froccaro said Sessa was working as a salesman at 4 Guys Motors in Brooklyn when he made contact with his old associates.
Despite now being on the up and up, most people refused to do business with him, Froccaro said. “His old friends were trying to help him make legitimate money and a living in the used car business,” Froccaro wrote.

Sessa, 52, who uses a walker and suffers from a litany of health problems including lupus, morbid obesity, spinal stenosis, diabetes and coronary heart disease, blew his family a kiss in court.
Froccaro had asked that the convicted mobster be sentenced to time served for the parole violation, citing his many hospital stays and extensive pain while awaiting judgement in Metropolitan Detention Center since September.
Sessa needs spinal surgery to relieve excruciating pain and increase his mobility and heart surgery to repair blockage in his aorta that could kill him if untreated.
He violated parole by using six burner phones to communicate with at least two former Colombo family associates between December 2017 and July 2018.
“When someone goes through extraordinary lengths by using six disposable phones there's an obvious attempt to evade the probation departments condition,” Matsumoto said.
Sessa previously served five months for a similar violation.
“It is a concern that there is a seeming lack of understanding or appreciation or respect for the law,” Matsumoto said.
Sessa was initiated by acting boss Andrew "Mush" Russo the night of Jan. 12, 2011 following a sting operation that landed over 100 mobsters behind bars. Sources told the Daily News the secret ceremony took place in the intake room of the Metropolitan Detention Center after the lot had been arraigned.
The wise guy was serving a three-year term of supervised release following an 87-month stint in prison for a 2012 guilty plea to racketeering charges when he violated parole.

Government accidentally erased videotaped Colombo induction ceremony

FEDERAL prosecutors would show a bombshell video of a mobster becoming a made man behind bars, but there’s one problem — a prison official erased the tape!
The feds claim that Ilario "Fat Larry" Sessa was inducted into the Colombo crime family at the Metropolitan Detention Center in Brooklyn by then-acting boss Andrew "Mush" Russo after more than 100 gangsters were rounded up by the feds in January 2011.
Mob rat Reynold Maragni provided the account, though said he was not present for the ceremony, a source said.
Sessa’s lawyer demanded the government back up its talk by handing over surveillance tapes from the high-security facility, which is wired for pictures wall-to-wall.
Under pressure to respond to Sessa’s lawyer’s denials, the feds have been forced to admit that they don’t actually have the Jan.` 21 footage, which they claim would show the ultimate mob ceremony.
An FBI agent said he saw the video, which showed “several defendants . . . variously entering and exiting Andrew Russo’s cell,” according to papers.
The agent requested a DVD copy of the tape, but a prison staffer “failed to properly burn the video.” So the agent contacted the prison for a new copy, but was told that the original tape had been overwritten, prosecutors stated.
Defense lawyer Vincent Romano has maintained the snitch’s claim is bogus. “I’m not surprised the government erased the tape of a so-called event that never happened in the first place,” the lawyer told the Daily News.
Romano also asked for a list of all the alleged mobsters who supposedly attended the blessed event — but prosecutors said they would not provide the list.
There seems to be little question about Sessa’s connection to the mob, given that he is expected to plead guilty soon in Brooklyn Federal Court. But the question of whether he is a “made” man or just a soldier is central because prosecutors are expected to argue at sentencing that a high-ranking member of the mob should get more jail time than a mere criminal associate.
Footage of a mob induction ceremony is considered the holy grail of Mafia buffs.
In the ceremony, a mobster holds a gun and swears allegiance to the crime family as his finger is pricked with a knife and the blood smeared on the picture of a saint. The picture is then set on fire and the wiseguy warned that he will burn in hell like the picture if he ever violates the oath of secrecy, or omerta.
In the alleged Metropolitian Detention Center ceremony, a prop would have had to replace a gun.
There is an audiotape of a ceremony secretly recorded among members of the Patriarca crime family of New England, but there are no known videos of such a ceremony.

WHO'S the boss?
A seemingly low-level mobster put the kibosh on plea deals that four Colombo wiseguys — including the crime family's acting boss — were ready to take Friday.
Then again, Angelo "Little Angelo" Spata is no ordinary mob associate.
Spata is the son-in-law of the crime family's official boss Carmine "The Snake" Persico, who is serving a life sentence.
He’s charged with wire fraud in connection with Feast of Santa Rosalia in Bensonhurst and illegal gambling. He blew off federal prosecutors on Thursday and had a deadline of Friday to accept the deal.
He told them to stick it.
His hard-nosed bargaining left acting boss Andrew Russo, capo Dennis Delucia and soldiers Ilario Sessa and Joseph Savarese in the lurch.
“Everything has broken down,” Delucia's lawyer Robert LaRusso glumly informed Brooklyn Federal Judge Kiyo Matsumoto.
Assistant U.S. Attorney Elizabeth Geddes said in court that Spata’s move means everyone's plea offers were off the table.
The men can either go to trial or try to negotiate new deals on less favorable terms, officials said.
Since Spata is a member of the Persico royal family, the other gangsters have no choice but to abide by his decision and keep their mouths shut, sources said.
The sources also said Spata is gunning for the same sweet deal that his brother-in-law Michael Persico recently wrangled — which gave him protection from the guilty plea being used against him in any future prosecution.
“The government is going to regret (Michael Persico's) plea agreement for a long time because now everyone is going to ask for it,” a source said.
This is Spata’s first arrest, and he faces about 20 months in prison.
Spata operates a company that rents amusement park rides to neighborhood Italian feasts and carnivals throughout the city. While he's co-defendants stew in jail, he's been free on $1 million bail. Prosecutors last year agreed to allow him to jet to Venice and Paris for second honeymoon with his wife Barbara.
Mob rat Anthony Russo testified in June that Spata was eagerly looking forward to becoming a made man in the crime family. Spata's lawyer Joseph Corozzo declined to comment.

Feds say Colombo mobster was inducted into the crime family while in jail

Federal prosecutors say mobsters didn’t let prison bars be an obstacle to Omerta when they carried out the secret Sicilian ceremony inducting a Colombo gangster into the family inside a Brooklyn federal lockup on Jan. 12, 2011.
That was the day more than 100 gangsters were rounded up in the metropolitan area in what the feds called a historic takedown.
It turned out to be a big day for Ilario "Fat Larry" Sessa, 45, who got arrested — and got his button.
Assistant U.S. Attorney Elizabeth Geddes disclosed in papers filed Wednesday in Brooklyn Federal Court that then acting Colombo boss Andrew "Mush" Russo personally inducted Sessa in the prison ceremony.
Sources told the Daily News the secret ceremony took place in the intake room, or bullpen, of the Metropolitan Detention Center in Sunset Park on the night of Jan. 12, after the mobsters had been arraigned in court.
“It was his [Sessa’s] lifelong dream to become a wiseguy,” a law enforcement source told The News.
He was supposed to have become a soldier Dec. 7, 2010, at the home of Colombo soldier Emanuele Favuzza, but the ceremony was scrapped after FBI surveillance was detected.
The feds learned of Sessa's new status in gangland from capo Reynold Maragni, who was also nabbed in the roundup and began cooperating after he made bail.
It is not clear whether he witnessed the ceremony.
Sessa’s lawyer, Vincent Romano, called the induction scenario far-fetched. He noted that the intake room at the MDC is under video surveillance and staffed by guards.
“I don’t think that the props that are typically used in an induction would be present in the intake room of the prison,” Romano said.
Over the years, mob turncoats have revealed the secrets of the ceremony: the inductee’s finger is pricked with a needle and his blood is dripped or smeared on a picture of a saint; the paper is lit with a candle and placed in his hand, and he holds the burning paper while reciting an oath of eternal fealty. A gun must also be present, to symbolize crime.
The prison bullpen is a holding area with benches seating about 20 new arrivals at a time. With everything but the clothes on their backs taken away — no saint picture, candle or weapons — the gangsters would have had to do a lot of improvising.
It’s happened before. In 1993, Luchese underboss Anthony "Gaspipe" Casso inducted mobster Michael "Baldy Mike" Spinelli in the bathroom at the Metropolitan Correctional Center in lower Manhattan. The gangsters set toilet paper on fire in Spinelli’s hands to substitute for the saint picture.
Sessa, charged with racketeering and extortion, is still being held at the MDC.
